Terms of Service
- Our acceptable
use policy is actively and strictly enforced. Offending
content or users are removed from our Network, as soon as they
are discovered,
Although we will always inform you
when and why any action has been taken.
Illegality
In any form, including
but not limited to the unauthorized distribution or copying of
copyrighted software or other data, harassment, fraud,
trafficking in obscene material.
Undesirable Content
Certain types
of content are not allowed on our network. We do not host
adult content of any description. Content relating to Hacking,
Cracking, Warez and IRC is not allowed. Software downloads may
only be hosted if you are the writer and copyright owner of
the software, all other software including freeware, shareware
and trial software is forbidden. Audio and video downloads may
only be hosted if you are the creator and copyright owner of
the work.
Bulk
Email
The use of our network to send bulk email
whether opt-in or otherwise, and the use of bulk email to
promote a site on our network is strictly
forbidden.
Telnet/Shell
Access
We do not in any way provide any type of
shell access. All items that shell access is needed for can be
handled by modern ftp software and the control
panel.
Misuse Of
Resources
Including but not limited to employing
applications which consume excessive CPU time. Chat/IRC, web
proxy and mailing list scripts are not allowed on our network
under any circumstances. Streaming media can be a drain on web
server resources and as such is not allowed. CGI based message
forums are often found to use excessive system resources and
are not allowed, to avoid problems please use a PHP/ASP
message forum.
If you are unsure about content you
intend to place on our network, please check with us before
you do. We reserve the right to determine what constitutes
acceptable use. We may amend these terms of service with or
without notice.
Please Note:
We Do Not Allow Adult Sites,
mp3storage, movie files, warez and other illegal contents. We
do reserve the right to delete all accounts if any one is
found in violation of allowable content, without
refund.
- Terms Of
Service Violations:
- Violations of Dynamic Hosting
Terms Of Service will result in immediate account
termination and provider reserves the right to charge up to
$500 administrative clean-up fee and a $50 deactivation
fee.
- Dynamic Hosting subscribers will
be held responsible and accountable for any activity by
third parties, using their account, which violates
guidelines created within the Terms Of Service. Violations
of Dynamic Hosting Terms Of Service will result in immediate
account termination and provider reserves the right to
charge up to $500 administrative clean-up fee and a $50
deactivation fee.
- If a Dynamic Hosting account is
used to violate the Terms Of Service or our TOS, we reserve
the right to terminate your service without notice. We
prefer to advise customers of inappropriate behavior and any
necessary corrective action; however, flagrant violations of
the Terms Of Service will result in immediate termination of
service. Our failure to enforce this policy, for whatever
reason, shall not be construed as a waiver of our right to
do so at any time. Violations of Dynamic Hosting Terms Of
Service will result in immediate account termination and
provider reserves the right to charge up to $500
administrative clean-up fee and a $50 deactivation
fee.
- Fraudulent activity: Use of
Dynamic Hosting service to make fraudulent offers to sell or
buy products, items, or services, or to advance any type of
financial scam such as "pyramid schemes," "ponzi schemes,"
and "chain letters is strictly prohibited. Violations of
Dynamic Hosting Terms Of Service will result in immediate
account termination and provider reserves the right to
charge up to $500 administrative clean-up fee and a $50
deactivation fee.
Fraud: Involves a knowing
misrepresentation or misleading statement, writing or
activity made with the intent that the person receiving it
will act upon it.
- Illegal use: Dynamic Hosting
services may not be used for illegal purposes, or in support
of illegal activities. Dynamic Hosting reserves the right to
cooperate with legal authorities and/or injured third
parties in the investigation of any suspected crime or civil
wrongdoing. Violations of Dynamic Hosting Terms Of Service
will result in immediate account termination and provider
reserves the right to charge up to $500 administrative
clean-up fee and a $50 deactivation fee.
- Harm to minors: Use of the
Dynamic Hosting service to harm, or attempt to harm, minors in any
way, including, but not limited to child pornography.
Violations of Dynamic Hosting Terms Of Service will result in
immediate account termination and provider reserves the
right to charge up to $500 administrative clean-up fee and a
$50 deactivation fee.
- Threats: Use of the Dynamic
Hosting service to transmit any material (by e-mail,
uploading, posting or otherwise) that threatens or
encourages bodily harm or destruction of property.
Violations of Dynamic Hosting Terms Of Service will result in
immediate account termination and provider reserves the
right to charge up to $500 administrative clean-up fee and a
$50 deactivation fee.
- Harassment: Use of the Dynamic
Hosting service to transmit any material (by e-mail,
uploading, posting or otherwise) that harasses another.
Violations of Dynamic Hosting Terms Of Service will result in
immediate account termination and provider reserves the
right to charge up to $500 administrative clean-up fee and a
$50 deactivation fee.
- Forgery or impersonation:
Adding, removing or modifying identifying network header
information in an effort to deceive or mislead is
prohibited. Attempting to impersonate any person by using
forged headers or other identifying information is strictly
prohibited. The use of anonymous re-mailers or nicknames
does not constitute impersonation. Violations of Dynamic
Hosting Terms Of Service will result in immediate account
termination and provider reserves the right to charge up to
$500 administrative clean-up fee and a $50 deactivation
fee.
- Infringement of Copyright,
Patent, Trademark, Trade Secret, or Intellectual Property
Right: Distribution and/or posting of copyrighted or the
aforementioned infringements is strictly prohibited.
Violations of Dynamic Hosting Terms Of Service will result in
immediate account termination and provider reserves the
right to charge up to $500 administrative clean-up fee and a
$50 deactivation fee.
- Distribution of Viruses:
Intentional distribution of software that attempts to and/or
causes damage, harassment, or annoyance to persons, data,
and/or computer systems is strictly prohibited. Such an
offense will result in the immediate termination of the
offending account. Violations of Dynamic Hosting Terms Of
Service will result in immediate account termination and
provider reserves the right to charge up to $500
administrative clean-up fee and a $50 deactivation
fee.
- Money
Back Guarantee:
All of our virtual web hosting
plans comes with a 30-day money back guarantee, only if we
are unable to setup your account due to problems on our
side. You will receive a full refund excluding the domain
name registration fee, issued by Dynamic Hosting. This term
only applies if you cancel your account within 30 days of
its activation. Any requests for cancellation must be sent
at dyn_support@dynamichosting.us.
- Contract Renewal: All contracts
are automatically renewed for another term unless a written
notice of cancellation is submitted via email at
dyn_support@dynamichosting.us
at least
three weeks in advance of the renewal date / anniversary
date. If no correct notice of cancellation is given, all
contracts will be automatically renewed for another term
under the same conditions.
- Failure to pay: Provider may
temporarily deny service or terminate this Agreement upon
the failure of Subscriber to pay charges when due. Such
termination or denial will not relieve Subscriber of
responsibility for the payment of all accrued charges, plus
reasonable interest and any collection fees. If a credit
card payment is declined by the client's bank or if the rent
is not paid on time provider may charge a US $15 late fee
per billing cycle and a US $50 fee for each payment-related
suspension. If the account needs to be reactivated following
a termination, a one-time $49.95 fee will apply.
- All username and domain name
changes are priced at $19.95 per change.
- Dynamic Hosting does not issue
refunds for any of its services. Even though our policy
specifies no refund for late cancellations, there will be
some cases where we will be able to issue partial refund
with managerial approval. Any length of time shorter than
one month of service is billed as a whole month of service
for all packages.
- For accounts billed on
quarterly basis, the refund for unused services is
calculated as follows: the number of months of used
service is multiplied by the standard monthly rate. The
amount due for services used will be deducted from the
total amount of order, and the difference, if any, will be
refunded immediately upon the management's approval to the
credit card we have on file.
- For accounts billed on yearly
basis, the refund for unused services is calculated as
follows: the number of months of used service is
multiplied by the special monthly rate. The amount
due for services used will be deducted from the total
amount of order, and the difference, if any, will be
refunded immediately upon the management's approval to the
credit card we have on file.
- For accounts billed on
biennial basis, the refund for unused services is
calculated as follows: the number of months of used
service is multiplied by the standard monthly rate. The
amount due for services used will be deducted from the
total amount of order, and the difference, if any, will be
refunded immediately upon the management's approval to the
credit card we have on file

If client disputes justified
charges by provider on his or her credit card, provider has
the right to charge a $50 administration fee in addition to
the regular suspension charge of $25 and immediately
discontinue service.
